In Vinnitsa region, not all developers are equity participation in the development of human settlements, as prosecutors apply to the court
Prosecutor's Office representative character is being taken on obligations ’ Liabilities developers in cases established by law to promote the development of settlements through equity. In particular, the prosecutor's office in Vinnitsa region of interests Zhmerynka City Council representatives ’ manifest claim to the developer, who declined to contract on equity participation in the development of engineering, transport and social infrastructure, payments to the budget and works of improvement. Currently, the lawsuit is pending trial. Reference: According to Article 40 of the Law of Ukraine « on Urban Planning » developer who intends on building land in corresponding settlement must take equity participation in infrastructure development of the settlement of up to 10 percent of the total estimated construction cost about ’ object – for non-residential buildings and sporud and 4 percent – for residential buildings.
