In the Transcarpathian region prosecutor's office launched criminal proceedings against judges rendered by the Court of Appeal decision which deliberately wrongful detention of suspects in the murder released

March 5 Zakarpattia Oblast Prosecutor's Office initiated criminal proceedings against judges appellate court Transcarpathianregion into the delivery of them deliberately wrongful decisions – Part 2 of Art. 375 of the Criminal Code of Ukraine. As explained Transcarpathian region prosecutor Vladimir Janko: February 27, Court of Appeal Transcarpathian region composed of two judges presiding, in flagrant violation of the requirements of Part 3 st.331 Code of Ukraine, determined knowingly unjust ruling, which abolished hoothe shaft of the trial court to extend the detention of two suspects in the murder of resonance. Thus, February 27, the Court of Appeal announced only the operative part of the decision and announcement of the full text postponed to March 4, ie the date by which it was extended detention of suspects. As a result of such claimrotypravnyh action the court of appeal, on March 2, without notifying the prosecutor, alleged murderers wrongly released from custody, making it impossible to bring them to criminal liability for committing heinous, violent crimes. One of them was suspected of committing crimes under part 3 and 5. 27 pp 11,12 Part 2 of Art. 115, part 1, article.263 And part 4 st.358 Criminal Code of Ukraine (organization and commit murder in order, by prior conspiracy, illegal handling of weapons and forgery and use of forged document deliberately), another was charged pp 6, 11, Paragraph 2, Article 12. 115, Part 1 Art. 263 of the Criminal Code of Ukraine (murder committed in order, with the priorlanguage group of persons and illegal handling of weapons). With the sanction of the article is currently charged with the judges - Part 2 st.375 Criminal Code of Ukraine - by a judge (judges) knowingly illegal sentence, decision, ruling or that caused grave consequences or committed for mercenary motives or other personal interests, punishable in viewand imprisonment for a term of five years to 8 years - said the prosecutor.
