In the Rivne region there are provisions of the Law, which strengthened the responsibility for corruption offenses
The amendments made to the Criminal Code of Ukraine paragraph 2 of Part II "Final Provisions" Law of Ukraine "On the National Anti-Corruption Bureau of Ukraine", operating rules, which strengthened criminal liability for corruption crimesyniv. In addition, the Criminal Code is supplemented with a note in which definitions of "corruption crime." Thus, in accordance with changes in legislation in force since 25 January 2015, ruled out the possibility of release perpetrators of corruption offenses from criminal liability for their effective confession (Art. 45 of the Criminal Code of Ukraine), with reconciliationthe perpetrator and the victim (art. 46 of the Criminal Code of Ukraine), of a person on bail (art. 47 of the Criminal Code of Ukraine) and changing circumstances (Art. 48 of the Criminal Code of Ukraine), as well as the appointment of a more lenient sentence than provided by law (Art. 69 of the Criminal Code Ukraine) and release from probation (Art. Art. 75 and 79 of the Criminal Code of Ukraine). This means that the courts, in accordance with theseof the criminal law, are required to enact sentences being awarded penalties, sanctions set out in the relevant articles of the Criminal Code, without the use of recently existing rules on exemption from punishment. Of delay penalties not mentioned at all. In this regard, the prosecution Rivne region being taken for Mr.euhylnoho enforcement of the requirements of the law in the performance management procedure in criminal proceedings on corruption and determining the state prosecutor positions on penalties accused of crimes of this category. Note: corruption offenses under Art. 45 Criminal Code of Ukraine are the following offenses, unlessof them by committing malpractice: - Ch. 2, Art. 191 of the Criminal Code (misappropriation, embezzlement or appropriation of another's property through abuse of office); - Ch. 2, Art. 262 of the Criminal Code (kidnapping, extortion of firearms, ammunition, explosives or radioactive materials or acquisitionby fraud or abuse of authority of office); - Ch. 2, Art. 308 of the Criminal Code (kidnapping, extortion of narcotic drugs and psychotropic substances, their analogues or acquiring them), ch. 2, Art. 312 (the same on precursors), ch. 2, Art. 313 (same for equipment intended for the manufacture of narcotic pocies, psychotropic substances or their analogues, or acquisition of), ch. 2, Art. 320 (violation of the rules of narcotic drugs, psychotropic substances, their analogues or precursors), if all the crimes committed through abuse of office; - Ch. 1, Art. 357 of the Criminal Code (kidnapping, extortion commeentiv, stamps, seals, or acquiring them through malpractice or injury); - Ch. 2, Art. 410 of the Criminal Code (kidnapping, extortion of weapons, ammunition, explosives or other combat materials, vehicles, military and special equipment or other military equipment, and obtaining themby fraud committed by a military official of the abuse of power); - Art. 354 of the Criminal Code (bribery of employees, institution or organization); - Art. 364 (abuse of power or position); - St.364-1 Criminal Code (abuse of power by an official legal entity of private law, regardless of the claimravovoyi form); - Art. 365-2 of the Criminal Code (abuse of power by persons who provide public services); - Art. 368 of the Criminal Code (accepting the offer, promise or obtain undue advantage by an official); - Art. 368-2 of the Criminal Code (illegal enrichment); - Art. 368-3 of the Criminal Code (bribery of an official legal entity of private law, regardless of the legalforms); - Art. 368-4 of the Criminal Code (bribery of a person who provides public services); - Art. 369 of the Criminal Code (the offer, promise or giving of an undue benefit an official); - Art. 369-2 of the Criminal Code (abuse of influence); - Art. 370 of the Criminal Code (bribery provocation).
