Chernivtsi: Prosecutor demands return of private land KP "Park October"
Prosecutor of Chernivtsi in the interests of the Chernivtsi City Council, appealed to the Economic Court of Chernivtsi region with a claim to the CP "Park October" and private entrepreneurs to set aside the contract 70 from 05.30.2014 year according to Iwho park "October" private entrepreneur illegally allocated land area of ??4350 square meters for the installation of Circuit karting and summer playground, gazebos and our restaurant. Established that the cooperation agreement that Chernivtsi City Council has signed with PP is actually a land lease agreement, so must meet the requirements of the Land kodeConstitutional Court of Ukraine, the Law of Ukraine "On Land Lease", the Law of Ukraine "On Nature Reserve Fund" and other legal acts of Ukraine. According to the requirements of Art. 759 Civil Code of Ukraine under the lease the lessor transfers or agrees to transfer the property orendachevi in ??use for a fee for a specified period. However, in violation of the aboveregulations of Ukraine, the question of signing the cooperation agreement of 05.30.2014 year 70 Chernivtsi City Council and its executive committee was not considered and a decision not taken. The said cooperation agreement contrary to the decision of the 26 session of the 5th convocation from 26.07.2012 576 year, according to which prohibited the installation of temporary sporesbeats for doing business in the territory CE "Park" October "(except summer playgrounds and amusement).
