Prosecutor Lutsk returned to communal ownership of land plots in the Central Park of Culture and Rest named after Lesya Ukrainian. Back in April 2010, the town council decision to one of Lutsk entrepreneurs were granted Dr.Ozeville place on the land in the park group of small architectural forms of trade pavilion and outdoor cafes and hold children's playground for improvement of business activity for 10 years. This City Council has signed an agreement with the entrepreneur personal term easement. However, the decision of the City Council was illegal becauseand, under the current legislation, the establishment of servitude is only possible for the owner or land user neighboring areas in order to address the shortcomings of the site due to its location or natural state, if such shortcomings can not be eliminated otherwise. The City Council also provided a businessman who was zemlekorystuvasomething or owner of neighboring plots, the land is for doing business and setting it on small architectural forms. Thus, the prosecutor appealed to Lutsk, Volyn Oblast Economic Court for rescission of illegal decisions city council and to annul the contract of servitude. The court prosecutor's claimgranted and obligations of ’ solved entrepreneur release and return the land worth over 550,000 USD in community of property Lutsk.
